The Utah Code allows a title insurance agent to act as a Trustee as long as it can satisfy the three following criteria:&lt;br /&gt;
* holds a certificate of authority or license under Title 31A, Insurance Code, to conduct insurance business in the state;&lt;br /&gt;
* is actually doing business in the state; and&lt;br /&gt;
* maintains a bona fide office in the state;&lt;br /&gt;

In the event of a foreclosure (or at any time) the trustee’s role can be assigned to a substitute trustee by the lender/beneficiary.&lt;/div&gt;</summary>
