Overview

Missouri allows for the creation of condominiums. The rules governing condominiums in Missouri resemble those in most other states. Condominiums must be established by a recorded Declaration. The statute provisions allow for the conversion of an existing apartment building as well as providing for development phasing and transferable development rights.

Missouri has passed two condominium acts. The first, passed in 1963, is known as the "Lesser Act" and was superseded by an act passed in 1983, known as the "Greater Act", that was based on the Uniform Condominium Act. The Greater Act (Chapter 448.1-101) applies to all condominiums, but certain aspects of the Lesser Act still apply to condominiums created prior to 1983.

Definitions

Missouri's Condominium Act follows the standard definitions of dividing a condominium into Units, Common Elements or Areas, and Limited Common Elements or Areas. The Declaration is the document that creates the condominium. The term Master Deed is not used.
