Remote Online Notarizations (RON)

Pennsylvania's remote notarizations statute, 57 Pa. C.S. § 306.1, went into effect on October 29, 2020. This provision allows the personal appearance requirement of notarization to be satisfied by means of communication technology.
General requirements include:
- The notary must be located in PA at the time of the notarial act.
- The notarial certificate must disclose that the notarization was conducted using communication technology.
- The recording must be retained for at least 10 years, or as otherwise required by law.
- Generally, the notary must inform the PA Department of State that they will be performing notarial acts facilitated by communication technology, and what technology they are using. The notary should appear as "e-notary capable" in the Department's public database.
- Only vendors of RON technology approved by the Department of State can be utilized. So general video conferencing software like Skype, Zoom, and FaceTime alone cannot be used.
- Updated state guidelines must be followed, and the County where the property is located must be accepting e-recordings.
- All parties to the transaction must agree, in writing, to the use of specific remote technology procedure. Lender closing instructions must permit use of remotely acknowledged documents.
