Trustees

The Utah Code allows a title insurance agent to act as a Trustee as long as it can satisfy the three following criteria:

  • holds a certificate of authority or license under Title 31A, Insurance Code, to conduct insurance business in the state;
  • is actually doing business in the state; and
  • maintains a bona fide office in the state;

In the event of a foreclosure (or at any time) the trustee’s role can be assigned to a substitute trustee by the lender/beneficiary.
