Tenancy by the Entirety

A conveyance by deed to a married couple can be held as tenants by the entirety but only if the intention is expressly stated in the deed.

Joint Tenants with Right of Survivorship

Creation

A joint tenancy with right of survivorship is recognized in Florida provided the instrument creating the estate of joint tenancy expressly provides for the right of survivorship. The most common phrase is is, “as joint tenants with right of survivorship,” but as long as the intent is clear it is clear the estate is created. (see Sec. 689.15, F.S.)
