Overview

Access refers to the ability of a property to reach a publicly opened road. Although not strictly speaking a matter affecting title, access is insured under a standard title insurance policy. It is therefore necessary as part of an examination of title to determine whether or not a property has access to a public road or to except it from coverage when it does not.

Exception in Title Insurance Policy

The following exception should appear in any policy where the land being insured does not have verifiable access to a public road either because it is adjacent to a public road or through a documented easement:

"Right of access to an from the subject premises is hereby excepted from coverage."
