Title Insurance Agent Licensing
Overview
Licensing of Title Insurance Agents and Agencies is done at the state level. The types of licenses available and what functions the licensees are permitted or required to perform vary from state to state.
Types of Licenses
In most states, individuals agents are licensed. The license is typically called a title insurance agent or title insurance producer. In a few states the agency itself is licensed. In addition, especially in western states, the ability to conduct closings or escrow is a separately licensed function. In the eastern states, the ability to conduct a closing for an insured transaction is usually included as part of the agent/producer license except in states where closings must be conducted by an attorney.
Licensed Functions
Each state has certain activities that may only be performed by a licensed title agent/producer or under the agent's supervision. This can include sales, title examination, conducting closings, and signing documents in connection with insuring properties.
