Examination
- The Examiner should raise a requirement for a new survey to be produced on the Commitment when it is has been determined that the legal description of record is insufficient, there is some issue that could affect title, such as an encroachment or overlap.
- The Examiner should raise a requirement for a new survey or an existing survey along with a "no change" affidavit when some form of coverage dependent on a survey is requested.
- Any Survey found in the public records or provided to the Examiner should be incorporated into the Commitment as an exception. This is called "reading the survey" into the Commitment. Items found on the Survey do not need to be separately listed and can be incorporated into the exception by reference to the Survey itself. The reference to the Survey should be sufficient to uniquely identify it, including the title of the survey, who it was prepared by, and the date it was prepared along with the date of the last revision.
Curative
- New Survey due to title issue: Must obtain a new survey.
- New Survey or Existing Survey plus "no change" affidavit to fulfill underwriting requirements for coverage requiring a survey: Must obtain a new survey or an as-built survey plus a "no change" affidavit. A plat that does not show any structures is insufficient because it does now show the location of any existing structures.
Underwriting
- The Survey Exception may be removed from any Loan Policy for 1-4 family residential without any extra charge or endorsement so long as the examiner is not aware of any issues that would cause a problem.
- The Survey Exception may only be removed from a Owner's Policy or a Loan Policy that is not 1-4 family residential based either on a new survey or an existing "as-built" survey with a "no change" affidavit. There is no limitation on the age of the survey that can be used, but it must be provided with the affidavit if it more than six (6) months old.
